TxDOT reclaims
project savings
Earlier this month the
Texas Transportation Commission closed a legal loophole in the
pass-through tolling program that allows municipalities to save state
money when construction projects come in below the estimated cost.
The pass-through program is a way of using road-use metrics to determine
the rate at which the state reimburses local governments for road work
that municipalities paid for upfront. Previously, local governments
could simply pocket the difference on road projects that came in at up
to 20% cheaper than expected.
State officials say they would like to keep the money for use on state
highways, which are perpetually in need of funding for upkeep.
However, some local officials are chafing at this change in procedure -
especially since the new rules are intended to take effect on projects
that are already underway, with no grandfathering taking place.
"We've played by the law. Now you guys changed the rules and put this
project in jeopardy. I'm here to ask TxDOT to honor their end of the
agreement," said Fort Bend County Commissioner Richard Morrison.
Given the fiscal pressures on the state, it remains to be seen whether
or not officials like Morrison will get his wish.
There are almost a quarter-billion dollars' worth of pass-through
tolling projects currently being developed in Texas.
